Americans Misunderstand the Bitmex CFTC Probe

First off anyone critisizing leverage isn't a bonafied finance professional who has traded legacy markets. Natural Gas and Crude oil and Gold are all 100x leverage or 50x leverage domestically, legally, on US NFA CFTC regulated exchanges. Crypto is full of noobs who have no professional background training in derivatives. Period. And because of that you don't understand what the CFTC is doing, what Mnuchin is doing, what the CFTC has done in the past to Forex, and what they will do.

We as americans are going to have ALL leverage taken away. SeedCx, Baakt, LedgerX, and ErisX were given derivative license to offer physically backed UNLEVERAGED contracts. The regulators are showing 0 intention to offer regulated exchanges proper leverage. Mnuchin came on TV and basically, if you read between the lines said, we are going to go after overseas exchanges, which for all intents and purposes he should have just said Bitmex. It's not a coincidence.

It puts us a catastrophic disadvantage. And it's my livlihood and countless others. I hate legacy markets. I don't want to trade crude oil because I got pushed out of Bitcoin. This is Wallstreet shutting down competition so they can behave as middle men to keep middle class Americans under control. This is how the security and derivative laws are set up in America, to protect the rich and control the poor.

The US and UK government want to backdoor exchanges AND wallets with chain analysis and smart contracts tied to KYC so that they can control your money and force it onto centralized exchanges where they can arbitrarily sieze it, they want to control it just as if it were Fiat. They don't want you to hold your private keys. They are building a regulatory sandbox that forces you to put large lump sums of capital on centralized exchanges by taking away the ability to put small highly leveraged amounts on anonymous exchanges. Once they do this they have total control over you.

No overseas exchange can legally offer leveraged bitcoin to Americans because of Dodd Frank laws. So mandatory KYC, globally, which is what the Trump administration wants, is an effective ban on US citizens. They took away our ICO, IDO, and IEO, they are geobanning altcoins. Can you not get this through your head, they are intentionally trying to keep you poor. They are not protecting you.

I was just wondering something. I trade 3 pairs, GBPJYP, GBPUSD and USDJYP. My thoughts are as follows; if GBPUSD price increases = GBP bull = USD bear? GBP bull = USD bear = USDJPY prices drop?
So does a GBPUSD price increase result in a USDJPY price decrease?

US/UK/EU BTC Traders need more legal & regulatory advocacy

The legal compliance issues that are cited as the reason for our governments tormenting us and regulating us to death are actually in fact pretty goddamn complicated. A lot of it is about the Patriot act and them basically treating us like criminals and holding bitcoin to a double standard compared to cash.

Soon US citizens are not going to have access to any offshore leverage trading, it's quickly moving towards that with the increasing regulation. And yes there will be those of you who complain about leverage, but realistically, any trader who is a full time professional trader will simply move back to legacy if they lose leverage on btc. I have to focus on my career, I will move back to commodities, forex, and energies in a heart beat if I lose Mex to KYC. That's just the reality of it.
The Dutch are talking about effectively banning foreign firms from offering derivatives and services to dutch citizens. Multiple EU countries are talking similar things, and proposing massive deleveraging to comply with the ESMA laws. The goddamn FCA in the UK wants to outright ban bitcoin derivatives, which is insane.

From a legal standpoint we are just getting pummeled. States in the west are absolutely using double standards legally and punishing bitcoin traders in retail, while allowing complex legal institutional loopholes to remain open that allow hedge funds, banks, institutions, and family offices and ultra high networth individuals to continue to trade bitcoin on leverage and with special perks. If you think that type of double standard classist elitist thing is good for the fundamental nature of bitcoin, then I don't know what rock you've been living under, that's not how bitcoin is suppose to work man.

Kraken, Bitfinex, Binance, and FTX do not offer to US customers. Binance kicked us off, bitrrex delisted half of its coins, Circle left. Who's calling their representative? Who's calling the CFTC? Who's complaining? I have, I have called and faxed. But I seriously feel like we are getting steem rolled with no fight being put up.

These institutions which have indulged in manipulation are most often given a slap on the wrist warnings or a petty fine. Whereas Bitcoin ETF is denied time and again citing the potential for manipulation.
Any financial instrument that is traded can and will be manipulated, its just the nature of humans and greed. To call Bitcoin manipulated because of Tether is without logic, when historically every major financial institution has a long history of manipulating markets for their own benefit and every currency has been manipulated by the establishments that have a stake in it.
Eventually a global currency like Bitcoin does not need an ETF at all, however the excuses regulators and the banks that support them come up with are flimsy. They need to be called out for their double standards.

Have You Been Able to Get A Hold of a Crypto Policy Maker/Lobbyist/Legislator?

I thought about linking or sharing a legalish letter I wrote the CFTC in the hopes to gain some exposure and eyes on the issue, but it would go over the heads of a lot here and wouldn't get to the point.
I don't know how else to make this clear, anyone who is a trader in crypto who is american who relies on leverage and complex trading and hedging and management of their portfolios, we are as American Investors, and American US Citizen completely under threat regulatoryily from our own SEC and CFTC and a hostile Trump administration.

They are fully aiming to shut us out of foreign exchanges. They are actually taking a more harsh stance than they did with retail forex. They are basically going to break the industry at this point. A industry without derivatives is not sustainable, it's going to wreck the domestic market and push US citizens into other asset classes.

They have no plans of offering us a fair market or letting a domestic exchange provide proper leverage. Their motives for shutting down binance and all the other exchanges to US citizen are ulterior, bad faith, anti competitive, and absolutely draconian. Don't tell me, and don't let them tell you that it is to protect American investors. that is profound bullshit.

Every single asset class has derivatives. Everything that isn't a security can and is highly leveraged in order to manage portfolios. And Securities have Options. Modern finance cannot work without this. The US governments refusal to allow domestic American derivatives is unacceptable. Their neglect to this market and hyper regulation and lack of clarity is unacceptable. If you know ANY pro crypto policy maker and legislator, and lobbyist please reach out to them about the regulatory overreach and please list their name in this thread. You guys need to take this serious.

Stop running on and on about the meme leverage of Bitmex. This isn't about that. Study other finance and asset classes. This is about Bitcoin and Crypto having a fair normal comparative market infrastructure to all the other commodities and futures in the United States. And we should be allowed to use foreign brokers. This ECP shit has to end. IF you can get a foreign stock account, a foreign commodity account in Europe with KYC, it should be that way with crypto. this is unfair bullshit and unfair discrimination of Crypto just like retail forex, under the same rules. The US government is unduly applying Forex regulatory law to Bitcoin. That's why we get banned from every foreign exchange, thats why we aren't allowed. Because of Dodd Frank Act.

Nadex or Other Brokers?

Hey guys,
So I am totally new to reddit (at least for the posting side and not just for reading) so if I am violating anything in anyway please just let me know, but I have been learning to trade Forex specifically Forex binaries with nadex for about a 1 year and I have seen dramatic improvements in my trading I have been interested in investing all my life and still pretty young just looking for some direction. The reason I went with nadex was because I don't have to worry about taking my account negative off of a single trade, like other brokers because of leverage ( I assume?). I just have some questions for people that maybe are making some consistent profits off nadex?? I have been testing the Ichimoku cloud system on 15 minute charts focusing on 2 hour expiration's. The reason I went with nadex was I see that they are supposed to be CFTC regulated, but some people are still saying its gambling but then they say they still trade Forex, so just wondering especially for a US trader if there using forex.com?? I am not trying be offend anyone I am just confused and would like some clarification.... I am also starting to wonder if people that do trade Forex are generally using brokers like ninja trader or forex.com? I dont mind if i trade things other than binaries and get into regular Forex but I just don't like the idea of leverage trading, so are there some brokers that could be recommended?

Thinking about starting your own Forex Brokerage? The first logical question is "Where is the best location to incorporate and license your broker?".
However before we proceed on to answer this question, there are other related questions a person who has a serious interest in opening his FX Brokerage needs to answers.
Q1) Which regions are your going to concentrate on for retail clients?
Q2)When do you plan on launching your company & product?
Q3)How much money do you plan on establishing your brokerage?
Q4)Which business model are you going to have ? (STP,Market Maker,DD,Mixed)
Q5)Which bank will open you a corporate bank account?(depends on license & country of incorporation)
Q6)How're you going to collect the payments from your clients?
For the purposes of answering the question, we will divide certain geos(regions) in Tiers based on the level of reporting, capital requirement & tight regulated environment each jurisdiction has.
1) Tier 1 :
To safeguard investors from fraudulent and ponzi schemes, many countries have established private or state owned organizations to monitor and regulate the Forex Market and are actively supported by the governments. Example of countries in this Tier are JAPAN(FSA JAPAN) & USA(NFA & CFTC).
There are profound reporting requirements, broker required to provide high quality in services and prove the availability of $20 Million USD of free liquid capital not including clients money. There is also a compulsion to have local offices and a significant membership fee as well.
2) Tier 2:
Regulations like FCA UK & ASIC Australia fall under this category. These jurisdictions require lower initial capital and are committed to reporting. Obtaining a license from these authorities may take anything between 6 months to a year depending on how fast the required documents are submitted.
Applying for a license from these regulatory authorities typically requires one to have a minimum of $100,000 USD of non client funds. The cost for this is approximately $35,000 to $50,000(depending on what license you take) for example if you plan to have a Dealing Desk which doesn't forward the liquidity flow to a third party then you need to show a high availability of disposable liquid funds available approximately $1 Million USD where as for STP(Straight Through Processing) models where you forward all the liquidity flow it's about $100,000 USD.
3)Tier 3:
Offshore with certain level of protection for investors like Cyprus(CySEC),, Malta(MSA), New Zealand (FSP) are the Tier 3 jurisdictions.
These regulators require the availability of a local office, simpler reporting & very low taxes. Specially Cyprus which offers good access to EU and is also ESMA compliant. The cost for CySEC range from 125,000 Euro to 750,000 Euro depending which model you're going for STP or Dealing Desk and the process time remains on par with the Tier 2 regulators.
4)Tier 4:
BVI, Marshall Islands, Belize & Seychelles are the Tier 4 jurisdiction and have a official regulation and license the broker needs to obtain if providing FX Instruments. Obtaining a license and getting a license usually takes 3-4 months and cost around $20,000 to $30,000 USD with a $500,000 USD in capital requirement(Belize). Also with these licenses it's easier to open and maintain a bank account.
5)Tier 5:
There are certain offshore jurisdictions Like St. Vincent & Grenadines or Bermuda where there getting a Forex license is not compulsory. Setting up a company needs only a little capital and the money saved can then be used on operations or marketing.
It's a bit difficult to obtain an account in a credible bank for Tier 5. Most startups go around this issue by listing their company for more than one service for example Consultancy, Marketing,FX, Travel etc or through EMIs which can provide an online IBAN. (B2B accounts mostly).
Many big brokers around the world start with small licenses and obtain their bigger licenses much later such examples include big names like Alpari, Admiral, Primus etc.

Bent u bekend met het feit dat een aantal mensen hiervoor lange gevangenisstraffen heeft gekregen? 5)   10 Bent u bekend met het feit dat DUFAS lid KPMG onder andere een schikking van het openbaar ministerie (OM) geaccepteerd heeft voor fraude en voor valsheid in geschrifte? 6)   11 Bent u op de hoogte van het feit dat een aantal bestuurders van DUFAS lid KPMG in de Verenigde Staten (VS) vervolgd worden voor het lekken van vertrouwelijke informatie over ophanden zijnde audits? 7)   12 Bent u op de hoogte van het feit dat het DUFAS lid UBS een schikking betaald heeft voor het manipuleren van de markten van edelmetalen en dat een trader van JP Morgan heeft toegegeven schuldig te zijn aan het manipuleren van de markt van edelmetalen? 8)   13 Bent u op dat hoogte dat DUFAS leden BNP Paribas, Citi, JP Morgan hoge boetes en/of afkoopsommen hebben betaald in de schandaal rondom fraude met swaps (Isdafix)? 9)   14 Klopt het dat pensioenfondsen in onder andere de VS schadevergoeding hebben   gekregen voor de schade die zij geleden hebben als gevolg van de manipulatie van de derivatenmarkt?   15 Klopt het dat de Nederlandse pensioenfondsen enorme derivatenposities innemen en dat zij bij marktmanipulatie dus zeer waarschijnlijk schade lijden?   16 Wilt u opnieuw de vraag beantwoorden of u op de hoogte bent dat de leden van DUFAS zich onder andere schuldig hebben gemaakt aan Libor fraude, Forex manipulatie, Euribor fraude, fraude met edelmetalen, fraude met Swaps (ISDA fix) en meer, en dat pensioenfondsen hierdoor schade hebben geleden?   17 Weet u of de vereniging DUFAS ooit enige maatregel heeft genomen tegen een lid vanwege bijvoorbeeld fraude of valsheid in geschrifte? Zo ja, kunt u dan een voorbeeld geven?   18 Is het u opgevallen dat de in de ijlings verwijderde modelovereenkomst van DUFAS was opgenomen dat "- De Fiduciair Beheerder is niet aansprakelijk voor schade, tenzij die het gevolg is van opzet of [grove] schuld van hemzelf [of van enige persoon voor wie hij krachtens de wet aansprakelijk is]. [De aansprakelijkheid voor zulke schade is beperkt tot aansprakelijkheid voor [directe] schade als gevolg van het bedoelde opzet of de [grove] schuld en omvat niet ook indirecte schade, waaronder begrepen maar niet beperkt tot gevolgschade, gederfde winsten en gemiste besparingen.] 
(artikel 23.1) - [De hoogte van de aansprakelijkheid van de Fiduciair Beheerder is beperkt tot een bedrag gelijk aan [â—?] maanden vergoeding als bedoeld in artikel 11.1.] (artikel 23.2) - Voorwaarde voor het ontstaan van enig recht op schadevergoeding is steeds dat de Cliënt de Fiduciair Beheerder schriftelijk in gebreke stelt en daarbij een redelijke termijn ter zuivering van de tekortkoming stelt, terwijl de Fiduciair Beheerder ook na die termijn toerekenbaar in de nakoming van zijn verplichtingen tekort blijft schieten. (artikel 23.3)"?   19 Deelt u de mening dat contracten die artikel 23.1, 23.2 en 23.3 bevatten, het bijna onmogelijk maken om een fiduciair beheerder aansprakelijk te stellen, omdat gederfde winsten en gemiste besparingen zijn uitgezonderd, de aansprakelijk gelimiteerd is tot een paar maanden vergoeding van de kosten betaald aan de beheerder en de fiduciair beheerder eerst in gebreke moet zijn gesteld en de mogelijkheid gehad moet hebben om zijn fout te herstellen?   20 Herinnert u zich dat u aan de Kamer schreef dat het pensioenfondsbestuur te allen tijde verantwoordelijk is voor het beleggingsbeleid en toezicht daarop? 10)   21 Is het pensioenfondsbestuur bestuursaansprakelijk, indien er sprake is van verlies door opzet of grove schuld bij de beheerder, maar die beheerder niet aansprakelijk gesteld kan worden omdat die via het contract gevrijwaard is van die aansprakelijkheid of in ieder geval het bedrag waarvoor die aansprakelijk gehouden kan worden, geminimaliseerd heeft? Kunt u het antwoord toelichten?   22 Bent u bereid om in overleg met de pensioenfederatie of de toezichthouder na te gaan of pensioenfondsen ooit een beheerder aansprakelijk hebben gesteld? Zo ja, kunt u dat voorbeeld dan vertrouwelijk delen met de Kamer?   23 Welke contacten heeft u (of uw ministerie) sinds 15 november 2018 met DUFAS gehad? Kunt u de e-mailberichten en gespreksverslagen van die contacten aan de Kamer doen toekomen?   24 Kent u de contracten tussen beheerders en pensioenfondsen? Rumor: Nadex is Opening Futures+Options for LTC.X & Ripple

Nadex Exchange already has Bitcoin Options you can trade, but they are adding option and monthly mini's contracts for BTC.X & option contracts for LTC.X & XRP.X. Nadex currently called up their MM's to structure Minis/Monthlies/Options and TeraBit approved the request. I assume they will release Fall'19 or sooner?
Nadex is a US Exchange regulated the same way as the NYSE and CME for Forex, Tech, and more markets which means they could only pull options/futures to trade these on a CFTC regulated exchange but honestly, limited risk on crypto is pretty much legit, imo.

New Beginner info / FAQ section for futures

I feel like with all the cheating and drama going on with spot fx we should at the very least have a dedicated section on the right for guidance on futures contracts.
The shady Cypriot brokers and ones on other random islands are lying and selling a dream so let's take a look at the reality of spot fx...
Currency markets are the most liquid and active markets of any sector. However, there is also a great deal of misinformation, slick advertising, and even outright deception regarding this $2 Trillion Dollar a Day marketplace. For starters, a large percentage of that $2 Trillion is traded through what is referred to as the interbank market. The interbank market is the top-level foreign exchange market where banks exchange different currencies. This trading between banks is not accessible to retail traders and is estimated to account for the vast majority of the Trillion Dollar liquidity factor that attracts so many retail traders in the first place.
Here are a few of the reasons to trade futures:
-Level playing field for all participants
-Deep liquidity on major currency contracts
-Safety and security of central clearing
If your Forex brokerage firm uses a dealing desk, your buy and sell orders never actually reach the true Forex market. In other words, you do not have access to the inter-bank market. Instead you are buying and selling at prices set, and potentially manipulated by the dealing desk. This is known as conflict of interest.
The Chicago Mercantile Exchange guarantees each transaction. Futures contracts are legally binding! This means that if you go long a currency futures contract and your speculation was correct, you will walk away from the trade with your profit even if the person that took the other side of the trade fails to pay. This is what we call counterparty risk.
Take a moment, have a break and take a look at all the horror stories on forex factory, for instance.
Whether you are a large institution or an individual trader, everyone is on equal footing when it comes to pricing currency futures. EVERYBODY gets the same price regardless of who you are (individual or mega bank). Best price wins, it is as simple as that — something that is not always the case in the fragmented OTC FX market. The spreads are also very tight if you trade liquid future contracts.
Spot fx brokers also control their price feeds. They can widen the spreads as they see fit and they can really screw you over if they want to. Believe me when I say that most fx brokers don't want you to win! Even the ones that claim to have liquidity providers... Those are nothing but price feeds. Quotes. Nothing more....
And Forex firms offering a "fixed" 3-5 point spread may not be charging traders commission outright, or even in a form that shows up on an account statement, but there are significant costs built into the synthetic market that they provide to you.
No middle man, no market maker. Yes, Forex is an electronic market, but your order still ends up on a "dealing desk" where a human handles your order. Or an algorithm... Basically, a Market Maker. He could make you or break you. With E-mini Futures you have a level playing field. You trade on a centralised and CFTC regulated exchange. Whether you're Goldman Sachs or Joe from Idaho, you get equal treatment!
If you're worried about Liquidity - 1.5-3m contracts trade hands everyday on the S&P 500 E-mini Futures Contract. If you want in or out of a position, there is almost always someone waiting and willing to take the other side of your trade (24/5) just 1 tick away. This simply isn't true for all Forex Pairs.
Low Cost of Doing Business - Commissions on a self directed SP500 E-mini Trade (ES) should be no more than $3.00 per side or $6.00 per round turn. While many Forex Brokers tout "Zero Commission", we all know there's no free lunch. Forex Brokers don't need to charge a commission because they make money off of the bid/ask spread "they create" and then take the other side of your trade. Run the numbers... for every $100 in profits or loss, you will spend a larger % in "cost of doing business" in the Forex Market than you will in the S&P E-mini Market. Don't take my word for it... go take some real trades and you'll quickly see the truth.
Zero Interest - If you you trade the ES intraday, expect to put up $500 per contract as a "bond" for lack of a better term. That's it. No hidden cost. Forex however, has a "cost of carry" associated which means interest may be charged or paid on positions taken.
Fiduciary Responsibility - Even regulated US Forex firms are not required to segregate customer funds. If a regulated firm goes under, you do not have the protection of the CFTC and the NFA as you do in the Futures Markets.
Turn ON The Volume Please - In Forex, since there is no centralised exchange, it is impossible to get a true read on volume. Not so with the S&P 500 "ES" E-mini. Simply turn on the volume indicator and you have exact numbers for Volume Analysis. GS and CITI have huge research departments with hundreds of employees, but they know nothing about volume that you don't know via a free indicator on your direct access trading platform. Just one more example of the level playing field we constantly speak of.
Centralised Clearing - All trades are cleared via the CME - Chicago Mercantile Exchange. All trades, including time and sales, are public information and posted in real time.
Edit: By the way, if you're worried about discrepancies, currency futures charts look almost exactly the same as their spot fx siblings! So you can easily apply your current strategy to this market, too!

The XTRD Megathread

What is XTRD?

XTRD is a technology company that are introducing a new infrastructure that would allow banks, hedge funds, and large institutional traders to easily access cryptocurrency markets.
XTRD is launching three separate products in sequential stages to solve the ongoing problems caused by having so many disparate markets. Firstly a unified FIX API followed by XTRD Dark Pools and finally the XTRD Single Point of Access or SPA.
Our goal is to build trading infrastructure in the cyptospace and become one of the first full service shops in the cryptocurrency markets for large traders and funds.

What are the industry issues?

COMPLEX WEB OF EXCHANGES. A combination of differing KYC policies, means of funding, interfaces and APIs results in a fragmented patchwork of liquidity for cryptocurrencies. Trading in an automated fashion with full awareness of best pricing and current liquidity necessitates the opening and use of accounts on multiple exchanges, coding to multiple API’s, following varying funding and withdrawal procedures. Once those hurdles are cleared, market participants must convert fiat currency to BTC or ETH and then forward the ETH on to an exchange that may not accept fiat, necessitating yet another transaction to convert back to fiat. Major concerns for market participants range from unmitigated slippage and counterparty risk to hacking prevention and liquidity.
HIGH FEES. Execution costs are even more of a factor. Typical exchange commissions are in the 0.1% – 0.25% range per transaction (10 to 25 basis points), but the effective fees are much higher when taking into bid and ask spreads maintained by the exchanges. As most exchanges are unregulated, there is generally no central authority or regulator to examine internal exchange orders that separate proprietary activity from customer activity and ensure fair pricing.
THIN LIQUIDITY. A large institutional order, representing a sizable percentage of daily volume can move the market for a product, and related products in an exchange by a factor of 5-10%. That means a single order to buy $1,000,000 worth of bitcoin can cost an extra $50,000-$100,000 per transaction given a lack of liquidity if not managed correctly and executed on only one exchange. By way of comparison, similar trades on FX exchanges barely move markets a fraction of a percent; those price changes cost traders money, and deter investment.
